Beyond Yoga UGC Terms & Conditions
LEVI STRAUSS & CO. UGC TERMS AND CONDITIONS
BY POSTING, SUBMITTING OR UPLOADING USER GENERATED CONTENT (“UGC”) WHETHER THROUGH THE LEVI STRAUSS & CO. WEBSITE, BEYOND YOGA WEBSITE, ANY SOCIAL MEDIA SITE OR OTHERWISE, YOU (ALSO “PARTICIPANT”) AGREE TO BE BOUND BY THESE UGC TERMS AND CONDITIONS (“UGC TERMS”), THE LEVI STRAUSS & CO. TERMS OF USE (“LS&CO. TERMS”), AND THE LEVI STRAUSS & CO. PRIVACY POLICY.
All of the foregoing is incorporated herein by reference, and shall, together with the UGC Terms, be a contractual agreement between Levi Strauss & Co. ("Levi Strauss & Co." or "LS&Co." or “us” or “we”) and you.
1. You may submit, upload, or post content you have created, including without limitation, photographs, your social media handle, videos, comments, ratings and reviews (collectively, “User Content”) through social media.
2. By submitting, uploading, or posting User Content that you have tagged with #liveinlevis, #MoveinBeyond or other Levi’s®, Beyond Yoga®, Dockers®, Denizen® and Signature by Levi Strauss & Co. brand hashtags (“Levi’s tags” or “Levi’s-tagged”), or by agreeing to have User Content featured by us, you grant LS&Co. and its third-party service providers who provide content management services located in the United States and elsewhere where the laws may be less protective of your personal information than your local laws (collectively, the “Licensed Parties”), the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your Levi’s-tagged User Content in any manner determined by us in our sole discretion, including but not limited to on our webpages, social media pages, and in other marketing, promotional and advertising initiatives, anywhere in the world in any media now or hereafter known.
3. By submitting, uploading, or posting your Levi’s-tagged User Content, you understand and agree further that we may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner, and you agree that you have no expectation that we will review, use, acknowledge, or compensate you for the same.
4. You also agree and grant the Licensed Parties the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Content, all in accordance with the LS&Co. Privacy Policy, which you confirm you have read and agree to. You represent and warrant that (i) you own all rights in and to your User Content, (ii) you have permission from any and all person(s) appearing in your User Content to portray them in your User Submission(s) and grant the rights granted herein; (iii) you are not a minor; (iv) if any of the individuals depicted in your User Content are minors that you are the parent or legal custodian of each such minor and you approve the use of the User Content containing the depiction of the minor(s) in accordance with these LS&Co. Terms; (v) the Licensed Parties’ use of your User Content as described in these Terms will not violate the rights of any third party or any law; and you (vi) FULLY RELEASE, DISCHARGE AND AGREE TO HOLD LS&CO., THE LICENSED PARTIES, AND ANY PERSON ACTING ON THEIR BEHALF, HARMLESS FROM ANY LIABILITY RELATED IN ANY WAY TO THE LICENSED PARTIES’ USE OF YOUR USER CONTENT.
